Terms of Service

1. Agreement to Terms

By accessing or using DESTILL.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Lebensfluss e.V. (ZVR: 1758759096), a registered association under Austrian law ("we", "us", "our").

2. Service Description

DESTILL.ai provides AI safety evaluation infrastructure, including:

LLM Prompt Scanning — Adversarial prompt detection via the 114-agent AEGIS cascade
AGI Safety Wrapper — Behavioral safety layers for autonomous AI agents
Validation Consortium — Collaborative testing and benchmarking platform
Red Team API — Automated adversarial testing endpoints
Tester & Wrapper Keys — Cryptographically signed evaluation credentials

3. Evaluation License

The DESTILL AEGIS SDK and evaluation tools are provided under the DESTILL AEGIS Evaluation License v1.0. Key terms:

Free evaluation is limited to 100 scans/day. For unlimited testing, request a tester key at validate@destill.ai.

4. Patent Notice

⚠️ Patent-Protected Technology

The cascade architecture, detection methodology, scoring algorithms, and related technologies are the subject of provisional patent applications filed with the USPTO. These applications cover, but are not limited to:

Multi-layer cascade threat detection architecture
Intention coherence scoring for prompt analysis
Self-improving feedback loops for defense adaptation (SIREN)
Cryptographic proof-of-auditable-work chains (POAW)
Ground Truth Oracle verification methodology (GTO)
Phi-harmonic threshold calibration (Stellschrauben)
Three-Chamber pattern memory quarantine (PMB)
Quantum-safe video compression (QFAI-C)

Using the evaluation SDK does NOT grant any license under these patents. Commercial use of the patented technology requires a separate license agreement.

5. Tester Keys & Wrapper Keys

5.1 Issuance

Keys are issued at our sole discretion for evaluation and validation purposes. Each key is:

Cryptographically signed with ML-DSA
Time-limited (default: 7–14 days, extendable upon request)
Bound to the email address and organization provided at registration

5.2 Restrictions

You may not:

Share, sell, or transfer your key to third parties
Use keys for production workloads without a commercial license
Reverse-engineer the key signing mechanism
Attempt to bypass scan limits or rate controls

5.3 Revocation

We reserve the right to revoke any key at any time for violation of these Terms, security concerns, or at our discretion.

6. Acceptable Use

You agree not to:

Use the Service to develop weapons, mass surveillance, or systems that violate human rights
Submit prompts designed to extract proprietary detection logic
Attempt unauthorized access to our infrastructure
Interfere with other users' access to the Service
Use the Service in violation of any applicable law

7. Intellectual Property

All intellectual property rights in the Service, including but not limited to the AEGIS cascade, detection algorithms, benchmark data, and documentation, remain the exclusive property of Lebensfluss e.V. and its licensors.

The DESTILL brand, logos, and design are trademarks of Lebensfluss e.V. You may not use these marks without prior written permission.

8. Identity Verification (OAuth)

If you choose optional identity verification via LinkedIn, GitHub, or Discord:

We receive only public profile information (name, avatar, profile URL)
We never request write, post, or message permissions
Verification is optional but may affect your Tester Bounty tier

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all adversarial inputs.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (IF ANY). WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Austria, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Vienna, Austria.

For EU consumers: Nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via our website at least 30 days before they take effect. Continued use after changes constitutes acceptance.
